In a landmark decision that underscores the growing accountability of builders in India, the Maharashtra State Consumer Disputes Redressal Commission has ordered Golden Dreams Builders Pvt Ltd to pay over ₹12 lakh in compensation to three homebuyers for delayed possession and failure to provide promised amenities.
The Case at a Glance
The complainants—Manjusha Bharadkar, Sunil Bharadkar, and Saurabh Bharadkar—had booked flats in a residential project by Golden Dreams Builders. Despite full payment, they faced significant delays in possession and found that essential amenities, including water supply, electricity, parking, compound wall, main entrance gate, underground drainage, and a transformer, were not provided as promised.
After hearing both sides, the commission, comprising presiding member Milind Sonawane and members Dr. Nisha Chavhan and Nagesh Kumbre, ruled that the builder’s actions constituted a clear deficiency in service under the Consumer Protection Act.
Commission’s Directives
In its order dated April 24, 2025, the commission directed Golden Dreams Builders to.
Provide the promised amenities within three months.
Issue the completion certificate for the flats within the same period.
Pay ₹5 lakh jointly to Manjusha and Sunil Bharadkar and ₹5 lakh to Saurabh Bharadkar, along with 9% annual interest from August 23, 2018, until full realization.
Pay ₹1.5 lakh towards compensation for mental harassment and ₹50,000 towards litigation expenses.
Implications for the Real Estate Sector
This ruling sets a significant precedent, emphasizing that builders must honor their commitments made to homebuyers. The commission highlighted that the delay and non-availability of basic infrastructure led to considerable inconvenience, warranting substantial compensation.
Legal experts note that such decisions reinforce the importance of transparency and accountability in the real estate sector. Builders are now on notice that failure to deliver on promises can lead to substantial financial and reputational consequences.
Conclusion
The Maharashtra consumer commission’s decision is a win for homebuyers and a reminder to builders about the importance of fulfilling contractual obligations. As the real estate sector continues to evolve, such rulings will play a crucial role in shaping a more accountable and consumer-friendly industry.
